Parents and physicians sued the Clovis Unified School District today over its high school abstinence-only-until-marriage sex education. The lawsuit charges that the district is violating California law and putting teens’ health at risk by teaching students misinformation and denying them critical instruction about condoms and contraception. The textbook that Clovis Unified uses for high school sex education does not mention condoms at all, even in chapters about HIV/AIDS and on preventing STDs and unintended pregnancy.

Major civil rights organizations have reached a settlement agreement with the Dinuba Unified School District (DUSD) to ensure that young English learners have an equal chance to succeed. The agreement, which was finalized at a school board meeting last week, comes as the result of a lawsuit filed in May by Dinuba parents and teachers. The plaintiffs are represented by the ACLU of Southern California, the ACLU of Northern California, the ACLU of San Diego and Imperial Counties, California Rural Legal Assistance, Inc., the Asian Pacific American Legal Center (APALC), and the law firm of Wilson Sonsini Goodrich & Rosati.

The law we co-sponsored with Planned Parenthood in 2004 has become a model for other states and for the national REAL (Responsible Education About Life) Act. After years of Bush Administration support for ineffective, biased and harmful abstinence-only education, the nation is poised to take a new direction, and many are looking to California as a leader.

In the span of four years, California voters three times rejected a ballot initiative that would require doctors to notify a pregnant teen's parent before an abortion. Propositions 73, Proposition 85 and Proposition 4 all proposed to amend the state Constitution to reverse the state Supreme Court ruling in an ACLU lawsuit that teenagers have fundamental rights to decide whether to end an unintended pregnancy.

The San Diego U.S. Attorney is treading dangerous legal ground with a legal opinion that seems to be threatening Del Mar city employees with prosecution if they comply with an ordinance on medical marijuana up for a vote in November. In a letter sent today, the ACLU of California called on Laura Duffy, U.S. Attorney for the Southern District of California, to assure voters that the federal government will not prosecute city employees for carrying out their duties if the local initiative passes in November.

Last week the Ninth Circuit Court of Appeals said it would rehear the ACLU of Northern California's lawsuit challenging a California law that mandates that DNA is collected from anyone arrested on suspicion of a felony. This suit is the only civil suit in the country challenging a disturbing trend toward invasive DNA collection of people who haven't been convicted of crime.
